These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "Seller," "Buyer," or "you") and BuyVahan.com ("Company," "we," "us," or "our") governing your access to and use of the BuyVahan.com website and associated mobile applications (collectively, the "Platform").

By accessing the Platform, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

 

1. Scope of Services (Classifieds Intermediary)

 

1.1 The Platform as a Venue: BuyVahan.com acts strictly as an online classifieds marketplace—a venue that allows users to publish advertising for vehicles ("Listings") and browse such Listings.

1.2 Non-Involvement in Transactions: We are not a party to any transaction between buyers and sellers. We do not:

  • Own, sell, buy, or rent any vehicles listed on the Platform.

  • Inspect, verify, or warrant the condition of any vehicle.

  • Handle payments between buyers and sellers (unless explicitly stated for premium listing fees).

  • Transfer legal title of vehicles.

1.3 No Agency: No agency, partnership, joint venture, employee-employer, or franchiser-franchisee relationship is intended or created by this Agreement.

 

2. User Accounts and Security

 

  • Registration: To post a listing, you may be required to create an account. You agree to provide accurate, current, and complete information.

  • Account Safety: You are responsible for safeguarding your password. You agree to accept responsibility for all activities that occur under your account.

  • One Account Per User: You may not create multiple accounts to manipulate listings or bypass bans.

 

3. Listing Policy (For Sellers)

 

By posting a Listing on BuyVahan.com, you warrant and represent that:

  • Right to Sell: You are the legal owner of the vehicle or a licenced dealer with authority to sell.

  • Accuracy: The description, mileage, condition, and photographs provided are accurate and not misleading.

  • Pricing: The price listed is genuine. You shall not list a vehicle at a fake low price to attract leads ("Bait and Switch").

  • No Duplicate Listings: You will not post the same vehicle multiple times or in incorrect categories.

  • Compliance: The vehicle is not stolen and does not have any undisclosed liens or encumbrances.

 

4. Buying Policy (For Buyers)

 

  • "As Is" Condition: You acknowledge that all vehicles are sold by third parties "As Is" and "Where Is." BuyVahan.com makes no representation regarding the safety, roadworthiness, or legal status of any vehicle.

  • Due Diligence: It is your sole responsibility to:

    • Physically inspect the vehicle.

    • Verify the Vehicle Identification Number (VIN) / Chassis Number.

    • Check official documents (Registration, Insurance, Pollution Certificates).

    • Verify the seller’s identity.

  • Payment Safety: You agree not to transfer money (wire transfers, advance payments) to a seller without physically seeing the vehicle and verifying documents. BuyVahan.com is not liable for financial losses due to scams.

 

5. Content and Intellectual Property

 

5.1 User-Generated Content: By posting photos, text, or data ("Content") to the Platform, you grant BuyVahan.com a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to use, copy, reproduce, distribute, display, and modify such Content for the purpose of operating and promoting the Platform.

5.2 Prohibited Content: You must not upload Content that:

  • Infringes on third-party copyrights (e.g., photos taken from other websites).

  • Contains offensive, defamatory, or hateful language.

  • Contains viruses, malware, or spam links.

 

6. Fees and Payments

 

  • Listing Fees: While basic browsing is free, BuyVahan.com may charge fees for certain services (e.g., "Premium Listings," "Bump Up," or Dealer Subscriptions).

  • Non-Refundable: Unless otherwise stated, fees paid for premium placement are non-refundable, even if the item is sold before the ad duration expires or if your account is terminated for violating terms.

 

7. Limitation of Liability

 

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • BUYVAHAN.COM PROVIDES THE SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS.

  • WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

  • WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM:

    1. YOUR USE OR INABILITY TO USE THE PLATFORM.

    2. ERRORS, MISTAKES, OR INACCURACIES IN LISTINGS.

    3. ANY FRAUDULENT ACTIONS OF THIRD PARTIES (BUYERS OR SELLERS).

    4. ANY PERSONAL INJURY OR PROPERTY DAMAGE RESULTING FROM MEETING A USER FOUND ON THE PLATFORM.

 

8. Indemnification

 

You agree to indemnify, defend, and hold harmless BuyVahan.com, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of your violation of these Terms, your use of the Platform, or your violation of any rights of another (including intellectual property rights).

 

9. Modifications to Services

 

We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Service.

 

10. Governing Law and Dispute Resolution

 

These Terms shall be governed by the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in [Irinjalakuda].
